Will of Benjamin Hingeston

I Benjamin Hingeston of the Parish of St Agnes in the County of Cornwall Gent being weak in Body but of a sound and disposing mind and memory do make and publish this my last Will and Testament in manner following first and principally I commend my Soul into the hands of Almighty God who gave it hoping in and through the Merits and Mediation of Jesus Christ my saviour to Inherit eternal life and for disposing of such worldly Effects as it hath pleased God to bless me with I Give and dispose thereof as followeth I Give and Bequeath unto my Daughter Mary the Wife of John Solomon of St Agnes aforesaid the sum of five hundred pounds to be paid her when and as soon that sum shall arise after payment of my Debts as nett Money clear of all Costs and Charges of Carrying on the same from and out of one sixth part share of my Rights shares and Doles of and in any Mines or Adventures for tin Copper or other Mettals or Minerals wherein I am now concerned or may be concerned at the time of my death but my Will and intention is that the said Money is not to be Paid to the said John Solomon or Mary his Wife during his lifetime but to remain in the hands of my Executor to and for the sole and seperate use of the said Mary exclusive of her said Husband he my said Executor yearly and every year after the said sum of five hundred Pounds shall be Produced and arise as aforesaid over and above all Costs and Charges paying the full Interest of the said sum at the rate of five Pounds Yearly for every hundred Pounds which is to be paid Quarterly into the hands of the said Mary and not to be subject to the Controul Debts or Engagements of her said Husband and that her receipt for the same shall be good and Effectual in the Law as if she was sole and unmarried but in Case my said Daughter shall happen to survive her said Husband then the said sum of five hundred Pounds to be paid to her but if she shall happen to die in the lifetime of her said Husband and leaving any Child or Children of her Body then the said Principal Money is to go and be paid to such Child or Children or laid out in the support and Maintenance of them until the said Principal sum shall become due and payable as aforesaid also I Give and Bequeath to my Daughter Elizabeth Hingeston the sum of five hundred pounds Provided so much shall arise or be produced after payment of my Debts and clear of all Costs and Charges aforesaid from the like and other sixth Part or share of my Right Parts and Doles of and in any of my Mines or Adventures for Tin Copper or other Mettals or Minerals wherein I am now or at any time hereafter shall or may be concerned but my will and meaning is that the said Money is not to be paid to my said Daughter Elizabeth but only the Interest thereof as aforesaid and to be paid her by Quarterly Payments unless she shall happen to Marry a Man capable of making and who shall make and settle on her a suitable jointure In which Case the said Principal sum is to be paid to her said Husband with Interest for the same in the mean time after such Principal sum shall arise after Payment of my Debts and Clear of all Charges as aforesaid all the rest residue and remainder of my Goods Chattels and Effects I Give and Bequeath to my Grandson James Hingeston to hold to him until he shall attain the age of twenty one years and do hereby Appoint him Executor of this my Will during the time aforesaid and do hereby Constitute and Appoint my son John Hingeston and John Tregelles of the said Parish of St Agnes Guardians or Trustees over my said Grandson and in Case my said Grandson shall happen to die before he attains the age of twenty one years or if he shall attain that age of twenty one years or if he shall attain that Age in either of the Cases the said Executorship shall cease and I do Constitute and Appoint my son John Hingeston Executor of this my said Will In witness whereof I have hereto set my hand and seal this twenty first day of January in the year of our Lord one thousand seven hundred and seventy three Benjn Hingeston
